1. scope of application
The following terms and conditions apply to all orders placed via our online shop.
2. contracting party, conclusion of contract
The purchase contract is concluded with Urban Art Organization GmbH.
By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping basket without obligation and correct your entries at any time before sending your binding order by using the correction aids provided and explained for this purpose in the order process. The contract is concluded when you accept the offer for the goods contained in the shopping basket by clicking on the order button. Immediately after sending the order, you will receive another confirmation by e-mail.
3. contract language, contract text storage
The languages available for the conclusion of the contract are German and English.
We do not store the text of the contract.
4. delivery conditions
Shipping costs are added to the stated product prices. You can find out more about the shipping costs in the offers.
You have the option of collecting your order from MUCA | Museum of Urban and Contemporary Art, Hotterstraße 12, 80331 Munich, Germany during the following business hours: Wednesday to Sunday: 10 a.m. to 6 p.m., Thursday: 10 a.m. to 8 p.m.
We do not deliver to packing stations.
5. payment
The following payment methods are generally available in our shop:
Paypal, PayPal Express
During the ordering process you will be redirected to the website of the online provider PayPal. In order to pay the invoice amount via PayPal, you must be registered there or register first, legitimise yourself with your access data and confirm the payment instruction to us. After placing the order in the shop, we request PayPal to initiate the payment transaction. You will receive further instructions during the ordering process.
Cash payment on collection
You pay the invoice amount in cash upon collection.
Prepayment
If you choose payment in advance, we will provide you with our bank details in a separate e-mail and deliver the goods after receipt of payment.
6. retention of title
The goods remain our property until full payment has been made.
7. transport damage
If goods are delivered with obvious transport damage, please complain about such faults to the delivery agent as soon as possible and contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, they help us to be able to assert our own claims against the carrier or the transport insurance.
8 Warranty and guarantees
Unless expressly agreed otherwise below, the statutory law on liability for defects shall apply.
The limitation period for claims for defects in used goods is one year from delivery of the goods.
The above restrictions and shortening of time limits shall not apply to claims based on damage caused by us, our legal representatives or vicarious agents
- in the event of injury to life, limb or health,
- in the event of intentional or grossly negligent breach of duty as well as fraudulent intent,
- in the event of a breach of essential contractual obligations, the fulfilment of which is a prerequisite for the proper performance of the contract and compliance with which the contractual partner may regularly rely on (cardinal obligations).
- within the framework of a promise of guarantee, insofar as agreed or
- insofar as the scope of application of the Product Liability Act is opened.

9. liability
For claims based on damage caused by us, our legal representatives or vicarious agents, we shall always be liable without limitation
- in the event of injury to life, limb or health,
- in the event of intentional or grossly negligent breach of duty,
- in the case of guarantee promises, insofar as agreed, or
- insofar as the scope of application of the Product Liability Act is opened.
In the event of a breach of material contractual obligations, the fulfilment of which is a prerequisite for the proper performance of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations) due to slight negligence on our part, on the part of our legal representatives or vicarious agents, the amount of liability shall be limited to the damage foreseeable at the time of the conclusion of the contract, the occurrence of which must typically be expected. Otherwise, claims for damages are excluded.
10. right of cancellation
With regard to the sale of admission tickets with a fixed validity date or period, the customer has no right of cancellation or return, as the provisions on distance selling do not apply to contracts for the provision of services in the area of scheduled leisure events in accordance with Section 312b (3) No. 6 BGB. Each order of such tickets is therefore binding immediately after confirmation or delivery and obliges the customer to accept and pay for the order.
In the case of orders for tickets and vouchers without a fixed validity date or books, catalogues and prints, the customer is entitled to cancel the order without giving reasons by declaration in text form and also by returning the tickets within 2 weeks.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken or has taken possession of the last goods.

11. cancellation conditions for guided tours
up to 1 week before appointment: free of charge
6-4 days before the date: Retention 50% of the tour price
3-2 days before the date: Retention 75 % of the tour price
1-0 days before the date: Retention of 100 % of the tour price
